Oregon has a regulated psilocybin-services framework for adults aged 21 and older. It is distinct from general retail availability.

  • The framework requires preparation and an administration session at a licensed service center with a licensed facilitator.
  • Products cannot be taken away for personal consumption. The program does not generally authorize possession outside its rules.
  • Psilocybin remains a Schedule I controlled substance under federal law. State permissions do not change that classification.

A licensed facilitator is not necessarily a medical practitioner. This overview does not establish personal eligibility or evaluate a service.

Personal-use protections and regulated services

Colorado has specified state personal-use protections for adults aged 21 and older and a separate regulated, supervised-services framework. These are different legal categories.

  • Personal-use protections do not create a general retail market. Public consumption and impaired driving remain prohibited.
  • The August 2026 law provides for limited regulated transactions associated with supervised administration at licensed premises; it does not create general take-home or online retail sales.
  • Psilocybin remains a Schedule I controlled substance under federal law, regardless of the state framework.

Netherlands

Mushrooms and sclerotia have different treatment

Information reviewed

Listed hallucinogenic mushrooms are prohibited under the Opiumwet. Reviewed official records distinguish sclerotia, often called magic truffles, from those mushrooms.

  • A ministerial answer distinguishes sclerotia from prohibited mushrooms. A 2024 tax judgment discusses untreated sclerotia separately from controlled preparations; the Supreme Court dismissed the tax appeal in April 2026.
  • That distinction is not a blanket legal determination for capsules, extracts, other preparations, medical services or cross-border activity.

The consolidated Opiumwet effective 17 September 2026 was reviewed on 19 September 2026. The cited court proceedings concern VAT; they do not establish permission for a particular product, preparation, service or cross-border activity.

Specific authorization required

Production, sale and possession of psilocybin are generally illegal without authorization. Canada has limited, case-specific medical and research pathways.

  • Health Canada describes clinical trials, the practitioner-requested Special Access Program and individual Controlled Drugs and Substances Act exemptions.
  • These pathways do not establish general retail permission or determine whether an individual qualifies.

Australia

Limited specialist medical framework

Information reviewed

Australia permits a limited medical pathway involving specifically authorized psychiatrists and psilocybin for treatment-resistant depression. It is not general retail access.

  • The framework requires relevant approvals and supervised administration in a health setting. Patients cannot take the product home.
  • Other uses remain subject to Schedule 9 controls and applicable research exceptions. State and territory requirements also apply.
